The Office of the General Counsel is responsible for addressing legal issues arising out of the activities of the Arlington ISD.

Subpoenas – Student Records

Pursuant to Arlington ISD Board Policy FL(LOCAL) the principal is the custodian of all records for currently enrolled students on their respective campus. The address of all District schools is made available in the Student Code of Conduct provided to students and parents at the beginning of each school year and here.

The Legal Office accepts service on behalf of the custodian of record. The Legal Office is located at:

The subpoena must:

  • Specifically name the custodian of record;
  • Comply with all requirements under applicable law;
  • Explicitly outline the records needed.

Pursuant to the Family Educational Rights and Privacy Act (FERPA), a lawfully issued subpoena permits AISD to provide educational records without the consent of the parent or eligible student. See 34 C.F.R. § 99.31(a)(9)(i). Subpoenas should be served with sufficient time for AISD to provide notice under FERPA. See 34 C.F.R. § 99.31(a)(9)(ii).

In order to expedite records releases and avoid the unnecessary removal of principals from their duties and responsibilities on their campus, AISD will provide a business records affidavit unless informed the principal’s testimony is material to the matter.
